This Privacy Policy explains how MagonShift ("MagonShift", "we", "our", or "us") collects, uses, stores, shares, and protects personal data when you access or use our website, applications, hosted forms, landing pages, APIs, and related services (collectively, the "Services").

2. Definitions
- Account means the account created by a Merchant or authorized User to access the Services.
- Customer means an individual who purchases or intends to purchase products or services from a Merchant using the Services.
- Merchant means the individual or legal entity using MagonShift to manage its business operations.
- Personal Data means any information relating to an identified or identifiable natural person, including names, phone numbers, email addresses, postal addresses, IP addresses, and any other information that may directly or indirectly identify an individual.
- Processing means any operation performed on Personal Data, including collection, recording, storage, organization, use, transmission, disclosure, modification, deletion, or destruction.
- Services means the MagonShift platform, website, hosted forms, landing pages, APIs, applications, integrations, and related services.
- User means any person authorized by a Merchant to access or use the Services.
3. Information We Collect
3.1 Account Information
When creating or managing an Account, we may collect: full name, business name, email address, phone number, billing information, account credentials, and profile information.
3.2 Customer Information
On behalf of Merchants, we may process Customer information including: full name, phone number, email address (where applicable), shipping address, wilaya and commune, order history, product selections and variants, delivery instructions, and communication history.
3.3 Business Data
We may process information relating to the Merchant's business operations, including products and inventory, orders and order status, shipment information, payment status, customer support records, and reports and analytics.
3.4 Technical Information
When you access the Services, we may automatically collect: IP address, browser type and version, device information, operating system, log files, date and time of access, usage statistics, and session information.
3.5 Information from Third Parties
Where integrations are enabled, we may receive information from third-party services such as e-commerce platforms, shipping carriers, payment providers, messaging providers, and other authorized integrations necessary to provide the Services.
4. How We Use Your Information
MagonShift uses Personal Data only for legitimate business purposes related to providing and improving the Services. We may use Personal Data to: create and manage user accounts; process and manage customer orders; provide hosted forms and landing pages; synchronize data with authorized third-party integrations; generate invoices, reports, and analytics; facilitate customer communications initiated by the Merchant; respond to support requests; detect fraud, abuse, unauthorized access, and security threats; monitor platform performance and reliability; improve existing features and develop new Services; and comply with legal obligations and enforce our Terms & Conditions.
We do not sell Personal Data to third parties. Personal Data is processed only for the purposes described in this Privacy Policy or where otherwise required or permitted by applicable law.
5. Legal Basis for Processing
MagonShift processes Personal Data only where there is a lawful basis to do so under applicable law. Depending on the circumstances, Personal Data may be processed to perform our contractual obligations and provide the Services requested by the Merchant; to comply with legal and regulatory obligations; to protect the legitimate interests of MagonShift, our Merchants, and our users (provided such interests do not override the rights and freedoms of individuals); where consent has been obtained, for the specific purposes for which consent was given; and to establish, exercise, or defend legal claims where necessary. Where processing is based on consent, consent may be withdrawn at any time without affecting the lawfulness of processing carried out before its withdrawal.
6. Sharing of Information
MagonShift does not sell Personal Data. We may share Personal Data only where necessary to provide the Services or where required by law.
6.1 Service Providers
We may share information with trusted third-party service providers who assist us in operating the Services, including cloud hosting providers, infrastructure providers, payment processors, communication providers, analytics providers, and technical support partners. These providers are authorized to process Personal Data only as necessary to perform services on our behalf.
6.2 Third-Party Integrations
Where a Merchant enables integrations with external services, MagonShift may exchange the information reasonably necessary to establish and maintain those integrations. Any information transferred becomes subject to the privacy practices and terms of the respective third-party provider.
6.3 Legal Requirements
We may disclose Personal Data where required to comply with applicable laws or regulations, respond to lawful requests from public authorities, protect the rights, property, or safety of MagonShift, our Merchants, our users, or others, prevent fraud, abuse, or security threats, or enforce our Terms & Conditions or other legal agreements.
6.4 Business Transactions
If MagonShift is involved in a merger, acquisition, investment, corporate restructuring, or sale of assets, Personal Data may be transferred as part of that transaction, subject to appropriate confidentiality obligations.
7. International Data Transfers
MagonShift may process or store Personal Data using infrastructure located in one or more countries. Where Personal Data is transferred across national borders, MagonShift will implement reasonable safeguards designed to protect such information in accordance with applicable legal requirements. By using the Services, the Merchant acknowledges that Personal Data may be transferred to and processed in countries where MagonShift or its trusted service providers operate. Personal Data remains under the control of the Merchant, except where MagonShift acts independently as required by applicable law.
8. Data Retention
MagonShift retains Personal Data only for as long as necessary to provide the Services, fulfill contractual obligations, comply with applicable legal requirements, resolve disputes, enforce our agreements, or protect the security and integrity of the Services. Upon termination of a Merchant's Account, Personal Data may be deleted, anonymized, or retained for a limited period where required by law or necessary for legitimate business purposes, backup procedures, fraud prevention, security, auditing, or dispute resolution. Where technically feasible and legally permissible, Merchants may request the deletion of Personal Data associated with their Account by contacting MagonShift.
9. Data Security
MagonShift implements reasonable administrative, technical, and organizational measures designed to protect Personal Data against unauthorized access, disclosure, alteration, loss, misuse, or destruction. These measures may include encryption of sensitive data where appropriate, secure authentication mechanisms, role-based access controls, regular software updates and security patches, infrastructure monitoring and logging, backup and disaster recovery procedures, and security testing and vulnerability management. Access to Personal Data is limited to authorized personnel and trusted service providers subject to confidentiality obligations. While we take reasonable steps to protect Personal Data, no method of transmission over the Internet or electronic storage system can be guaranteed to be completely secure.
10. Your Privacy Rights
Subject to applicable law, individuals whose Personal Data is processed through the Services may have certain rights, including the right to request access to their Personal Data; request correction of inaccurate or incomplete information; request deletion of Personal Data where legally permitted; request restriction of certain processing activities; object to processing in circumstances permitted by law; withdraw consent where processing is based on consent; and request a copy of their Personal Data where applicable.
Where MagonShift processes Personal Data on behalf of a Merchant, requests relating to Customer Data should generally be directed to the relevant Merchant, who acts as the primary controller of that information. MagonShift will cooperate with Merchants, where appropriate, to assist in responding to lawful privacy requests. We may request additional information to verify the identity of the individual making the request before responding.
11. Third-Party Services
To provide the Services, MagonShift may rely on trusted third-party providers, including cloud hosting providers, payment processors, shipping carriers, messaging providers (such as email, SMS, or WhatsApp providers), analytics services, and other business tools. Any Personal Data shared with a third-party provider is subject to that provider's own privacy policy and terms of service. While MagonShift carefully selects its service providers, it does not control the privacy practices of independent third-party providers and is not responsible for their policies or actions.
